Fleet Phospho-soda Lawsuits:

 

Since 2004, there have been more than 200 individual lawsuits filed against CB Fleet across the United States.  The plaintiffs in these lawsuits allege that they have suffered kidney failure, chronic kidney disease and end stage renal disease as a direct result of using Fleet® Phospho-Soda® in a dose recommended by Fleet as "safe."  Many people used Fleet Phospho-soda as a bowel cleanser prior to a routine colonoscopy.  Sadly because of their use of Fleet's Phospho-soda, many of these plaintiffs are undergoing dialysis while awaiting a kidney transplant.

 

Current Status of the Fleet Phospho-soda Litigation:

 

On June 23, 2009, The United States Judicial Panel on Multidistrict Litigation ordered that all federal lawsuits currently pending against Fleet alleging injuries resulting from the use of Fleet Phospho-soda be consolidated to a single United States District Court.  The Panel centralized the cases in the Northern District of Ohio before the Honorable Ann Aldrich. 

 

Q: Is This a CLASS-ACTION?  - A: NO.

 

The creation of the MDL does not create a class-action.  The MDL process is simply a pre-trial mechanism designed to encourage efficiency among similar claims brought in Federal court.  We continue to pursue our clients' claims individually.
